Entitlement to an Anw survivor benefit is subject to qualifying conditions. Which of these conditions apply depends on whether or not your partner or ex-partner has died. To determine which of these conditions apply, we assess the situation on the date of your partner or ex-partner’s death.
Your partner has died
If your partner has died, the following qualifying conditions must have been met on the date of their death:
- your partner was insured under the National Survivor Benefits Act (Anw )
- you had not yet reached your AOW pension age , and
- you were looking after a child under 18. The child was living with you and was not a member of another household, or
- you were at least 45% incapacitated for work
The Dutch Employee Insurance Agency (UWV ) will assess whether you are at least 45% incapacitated for work, also if you live outside the Netherlands. In that case, the UWV will contact the social security institution in your country of residence.
Your ex-partner has died
If your ex-partner has died, the following qualifying conditions must have been met on the date of their death:
- your ex-partner was insured under the National Survivor Benefits Act (Anw )
- you had not yet reached your AOW pension age , and
- your ex-partner was obliged to pay maintenance for a spouse or partner. It does not matter whether or not you actually received any maintenance payments
- you were looking after a child under 18. The child was living with you and was not a member of another household, or
- you were at least 45% incapacitated for work
The Dutch Employee Insurance Agency (UWV ) will assess whether you are at least 45% incapacitated for work, also if you live outside the Netherlands. In that case, the UWV will contact the social security institution in your country of residence.
